Privacy Policy

The intention and substance about the dissemination of personal information are not subject to change. Occasional changes to this policy will not reduce the privacy protection of members or queries by visitors.

1.      We maintain strict internal policies against unauthorized disclosure or use of member information. Member lists are not sold or distributed to third parties or other members. We will not use your email for advertisement. 

2.      We will not use tracking devices of any kind. Cookies are an example of tracking devices.

3.      If you choose to see an advertisement or promotion published on the left pane of our pages, your identification will not be tracked.

4.      You will control the privacy of your choice via editable options on your profile.

Membership

5.      We validate individual member identification for your personal security.  All transactions and personal information are maintained confidential except for username and member locality (township of residence.) 

6.      We will not knowingly accept members under the age of 16. Members between 16 and 18 years old may be contributors and volunteer to participate in events or support their local forum.  To vote or post proposals, the member must be 18 or older.

7.      Postings may include links to third party websites with different privacy policies than those set forth herein. We will not transmit your personal data and disclaim all responsibility for compliance with the privacy policies of those third party websites.

8.      You have control over the email you may receive from us. The Public-voice uses various member lists to inform users of project status and to send activity information and invitations for member participation in a particular proposal or event.  Members can edit personal options and opt out of receiving a particular type of email by clicking on the “Remove me from this list” hyperlink. However, certain email transactions are designed to ensure security of member identification besides authentication of voting privileges and are not subjected to this option.

9.      Only individuals can apply for membership.  No businesses, corporations, or agents representing another identity of any kind are allowed to register.

10.  When you chose to support a particular proposal (an initiative, petition, or amendment) then you are also authorizing the posting to list your support with your real name, city, state or province, and country.

11.  We will collect data about your postings to help us enforce compliance of your responsibility as declared below.

User Registration

12.  Public-voice is a secure website. Visitors may browse the site, look at the projects and activities data, but cannot interact with the site or members.

13.  Visitors have no access to members’ profiles or activities.

14.  Members can only interact with their established contacts and the Moderator for their selected groups or forums.

15.  User registration does not require that a member join any one group, local forum, or event, nor implies that the new member is in agreement with our mission.  A member may register with the sole purpose to vote against a proposal.

NOTE: YOU ARE CONCLUDING A LEGALLY BINDING AGREEMENT.

    Public-voice responsibility

16.  Within the financial constrains of a not-for-profit organization, we commit to provide tools and facilities for the activities of citizens safeguarding individual freedom and your rights to intervene on government matters. 

17.  As a member, you will be able to communicate with other members in a secure media allowing for a trusted relationship with individuals and groups.

18.  The data we collect from your interactions with the site (including IP address and timestamps) will be used strictly to diagnose problems with our servers, to administer the Foundation website, and to otherwise provide our services to you in a safe and secured manner.

19.  We will comply with lawful processes to the best of our ability and good faith.

20.  We shall not advertise or promote public office candidates, political parties, or religious advocacy.

21.  We shall not advertise products or services containing unproven claims or deemed offensive to third parties by our administration.

22.  We reserve the right to reject any proposed advertisement.

     Scope and Intent

23.  By registering on Public-voice.org you are entering into a legally binding agreement with Public Voice Foundation, a nonprofit organization being formed by Humberto Sachs of Hansville, Washington 98340, including the Privacy Policy which is hereby incorporated by reference.

24.  You acknowledge to truly being the individual indentified in your membership application and hereafter identified as “you” or “member.”

 Your responsibility

25.  You must comply with all applicable laws of your State and this Agreement, as may be amended from time to time with or without advance notice, and the following processes and conditions:

a.       You shall interact with other members in a cordial and respectful manner. You shall not use profanities nor promote nor post morality or religious proposals. It is to be understood that certain health or wellbeing proposals may refer to religion or morality; however, it cannot be the topic of any proposal.

b.      You will follow and submit to the guidelines of the group in which you choose to participate, as well as your Forum which is determined by your address.

c.       You will not submit posting containing triviality, occult arts, or pornography. 

d.      You will not submit copyrighted or patented data, art, or material other than your own or certified as public domain. You are solely responsible for such infringements.

e.       You agree that your data entered into Public-voice may be removed by others if considered inappropriate in accordance with this agreement. You will have recourse via an appeal to your local moderator. 

f.       While you may appeal via the proper channels within Public-voice, you will not hold us responsible for deletion of your data. Yet, offenders repeatedly deleting proper postings will be black listed, thus being limited to vote only.

g.      It is your responsibility to keep your Public Voice profile information accurate and updated.

h.      You shall keep your password secure and confidential with a minimum of eight digits. 

 Permitted materials

26.  The member may submit only properly compose proposals.

27.  The member may not submit materials that are illegal, obscene, threatening, defamatory, or otherwise contain any objectionable or inappropriate content, nor may you submit materials that injure or violate the rights of any third party, including privacy, publicity, copyright, trademark, patent, or other intellectual property rights.

License and warranty for your submissions to Public-voice.

28.  Once you submit information or data to Public-voice, you grant us a nonexclusive, irrevocable, worldwide, perpetual, unlimited, and royalty-free right to us to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, and use the information you provided directly or indirectly, without any further consent, notice, and/or compensation to you or to any third parties.

29.  The rights you grant to us in this paragraph extend to us and to any person or entity designated or engaged by us or acting on our behalf and are in addition to any rights we may otherwise have.

30.  By providing information to us, you represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights, as well as in compliance with our bylaws.

   Indemnification, representation and warranties

31.  You, the member represent and warrant that you have all the rights necessary to grant us the rights per this agreement and your submissions are not defamatory to any person or entity.

32.  You indemnify us and hold us harmless for all damages, losses and costs (including, but not limited to, reasonable attorneys’ fees and costs) related to all third party claims, charges, and investigations, caused by:

a.       Your failure to comply with this Agreement, including, without limitation, your submission of content that violates third party rights or applicable laws;

b.      Any content you submit to Public-voice.

   Limitation of Liability; Disclaimer of Warranties

33.  Public Voice tools, features, and functionality are made available “as is” and available when practical in accordance with our resources.

34.  To the fullest extent permissible under applicable laws, we disclaim any and all warranties, express or implied within Public-voice.  In no event will we be liable for any damages of any kind arising from your use of our free tools, including any direct, indirect, incidental, punitive or consequential damages. We take no responsibility and assume no liability for any materials submitted under your account.

  Notice of disagreement

35.  If you believe that you are entitled or obligated to act contrary to this Agreement under any mandatory law, you agree to provide us with detailed and substantiated explanation of your reasons in writing at least 30 days before you act contrary to this Agreement, to allow us to assess whether we may, at our sole discretion, provide an alternative remedy for the situation, though we are under no obligation to do so.

 Forum communication and sharing

36.  Users may privately communicate with other users within a given group, forum, or personal contacts made via the user profile tools. 

37.  User may promote within his or her group a new proposal or submit a poll to decide forum activities.

38.  Members are not allowed to advertise services or products via postings. Repetitive infringement of this rule by a member may lead him or her to be black listed.

39.  The member has the right and duty to flag improper material. However, a member may be also black listed if he or she consistently flags proper material indicating non-understanding of the rules.

Connections and Interactions with other Users.

40.  You are solely responsible for your interactions with other Users. Public-voice may limit the number of connections you may have with other members and may, in certain circumstances, prohibit you from contacting them, or otherwise limit your use of the Public-voice apps.

41.  We reserve the right, but have no obligation, to monitor disputes between you and other members and to restrict, suspend, or close your account if Public-voice determines, at our sole discretion, if it is necessary to enforce this Agreement.
